By booking a reservation at The Modernist Hotel or signing your registration card at check-in, you agree to abide by the terms and policies below. These terms are in place to ensure a safe, fair, and enjoyable stay for all guests, and to protect the integrity of our independently owned property.

Check-In

Check-in is available from 4:00 PM to 12:00 AM. Guests requesting an early check-in between 12:00 PM and 4:00 PM may do so for a $75 fee, subject to availability and housekeeping readiness. We do not allow check-ins before 12:00 PM; if you require an earlier arrival, we suggest booking the night prior as well.

Guests must be at least 21 years of age and present a valid physical government-issued photo ID and a physical credit or debit card at check-in. The name on the reservation must match the ID and card. Tap-to-pay is not accepted.

Check-Out

Check-out is by 11:00 AM. Late check-outs are strongly discouraged and may incur a $75 per hour charge plus tax, subject to availability. Guests who remain in the room past 1:00 PM may be charged for an additional night at the prevailing rate, regardless of whether they stay the full night, due to loss of availability to incoming guests.

Identification

All guests staying in the room must present a valid ID upon arrival to be scanned and attached to the reservation record. We reserve the right to deny access to individuals not listed on the reservation or without proper identification.

Credit Card Guarantee & Charges

A credit or debit card is required to guarantee all reservations. The hotel reserves the right to pre-authorize cards in advance of arrival for the full balance due. For flexible-rate bookings, we authorize the first night plus taxes/fees 48 hours prior to arrival. For non-refundable bookings, the full payment is due at time of booking and is non-refundable, non-transferable, and non-changeable.

Incidental Deposit

A $350 incidental deposit is required per room at check-in. This deposit will be voided or refunded after check-out, provided there are no damages, policy violations, or additional charges. The incidental deposit must be secured with a physical credit or debit card. We do not accept cash for incidentals.

Smoking

The Modernist Hotel is a 100% smoke-free property. Smoking of any kind—including cigarettes, cigars, e-cigarettes, or marijuana—is prohibited inside rooms, on balconies or patios, or in any indoor area of the hotel. A $350 cleaning fee will be charged for violations of this policy.

Pet Policy

We allow dogs only, with a maximum of 2 dogs per room and a 35lb weight limit per dog. A $100 cleaning fee is charged per dog, per stay. Dogs must be crated when unattended in the room. Emotional Support Animals (ESAs) are subject to the same pet fees. Registered Service Animals, as defined under the ADA, are exempt from the pet fee with proper documentation presented at check-in.

Quiet Hours & Parties

Quiet hours are from 10:00 PM to 7:00 AM, in accordance with NYC law. Disruptive behavior, parties, or loud gatherings are strictly prohibited. Guests who violate this policy may be asked to leave the property without refund.

Cot Policy

Twin-sized rollaway beds are available upon request for $30 per night. Quantities are limited and must be reserved in advance.

Daily Cleaning

Housekeeping services are provided daily between 9:00 AM and 6:00 PM. If a “Do Not Disturb” sign is displayed, service will be skipped. Linens are changed every 3 days for extended stays, unless otherwise requested.

Cancellation & No-Show Policy

Reservations must be cancelled or modified at least 48 hours prior to arrival to avoid penalty. Cancellations within 48 hours, as well as No-Shows, are subject to a charge of the first night’s room rate plus tax. Non-refundable reservations are strictly non-refundable and non-changeable, regardless of cancellation timing.

Same-day bookings are subject to the same 48-hour cancellation policy.

Early Departures

We do not provide refunds or credits for early departures. Guests are responsible for the full amount of the reservation, regardless of departure date.

Valuables

Guests are solely responsible for securing their personal belongings. The Modernist Hotel is not liable for any lost, stolen, or damaged items, regardless of whether they are left in the room, in safes, or with front desk staff. We strongly advise that valuables be kept on your person at all times.

Accessibility & Room Requests

Only guests with ADA-protected disabilities may request specific rooms to accommodate their needs. Room and floor preferences are not otherwise guaranteed.

Surveillance Policy

For the safety and security of our guests, video surveillance is used in all public areas of the hotel, including hallways, lobbies, and exterior entry points. By entering the premises, you consent to being recorded in these locations. Cameras are not installed in private guest rooms or bathrooms.

Parking

We do not offer on-site parking. Free street parking is available in the neighborhood, subject to local signage and regulations. Nearby private garages typically charge around $25 per night. Guests are responsible for reading all signs and complying with local laws.

Transportation

We are located within walking distance to the N, W, 7, E, and F subway lines, providing quick and easy access to Manhattan and surrounding boroughs.

Food & Beverage

We do not operate a full-service restaurant or bar. However, light snacks, candies, and soft drinks are available for purchase at the front desk.

Sustainability

The Modernist Hotel strives to be as eco- and animal-friendly as possible. We avoid animal-based design materials, using faux leather and vegan alternatives wherever possible.

Privacy Policy

We collect guest information solely for purposes of providing hospitality services, complying with legal obligations, and improving your guest experience. This includes information collected at the time of booking, during check-in, or while using our services. We do not sell guest information or use it for unrelated marketing purposes.

By booking a reservation or checking in, you consent to our collection, retention, and lawful use of your information, including scanned IDs, payment methods, and communication history. Information is stored securely and only accessed for operational or legal purposes. If you email or contact us through the website, your data may be stored to ensure quality of service and compliance with local law.

Disputes & Chargebacks

By booking a reservation and/or purchasing goods or services through our website or any third-party platform, you agree that the laws of the State of New York shall govern any disputes, without regard to principles of conflicts of law.

You agree to first attempt in good faith to resolve any billing concerns or disputed charges directly with The Modernist Hotel. If resolution cannot be reached, you agree that any disputes arising from or relating to your stay — including allegations of unauthorized charges — shall be resolved exclusively through binding arbitration under the Commercial Rules of the American Arbitration Association. Arbitration shall be conducted in New York City. Arbitration may not proceed as a class or consolidated action.
